COVID-19 WAIVER AND ACKNOWLEDGEMENT OF PERSONAL RESPONSIBILITY

By executing this registration, the attendee (“Attendee”) acknowledges that notwithstanding any safety precautions NATM implements, as required by applicable law or otherwise, with respect to the 2025 NATM Trailer Expo (which includes any and all related and affiliated activities, collectively the “Trailer Expo”) in an effort to reduce the transmission of the Coronavirus, or any other contagious disease (“COVID-19”), Attendee’s attendance at the Trailer Expo may increase the risk that Attendee will contract COVID-19, and NATM cannot and does not guarantee that Attendee will not become exposed to or infected with COVID-19 as a result of Attendee’s attendance at the the Trailer Expo.

Attendee acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk of exposure to and infection by COVID-19 by attending the Trailer Expo and that such exposure or infection may result in Attendee’s serious personal injury, illness, permanent disability, and/or death.

Attendee acknowledges that Attendee’s risk of becoming exposed or infected with COVID-19 by attending the Trailer Expo may result from the actions, omissions, or negligence of others, including but not limited to NATM (including its employees, agents, and representatives), other attendees of the Trailer Expo (including other NATM members and exhibitors), staff of the convention center and other persons present in the convention center unrelated to the Trailer Expo, and employees and guests at the hotel which Attendee booked through NATM. Attendee expressly assumes all such risks.

Attendee releases, waives, and agrees to indemnify, defend, and hold harmless NATM (including its employees, agents, and representatives) from and against any and all liability, claims, demands, causes of action, judgments, and costs, including attorney’s fees and court costs, for or related to any and all personal injuries and/ or damages of any nature arising out of or related to Attendee’s exposure to or contraction of COVID-19 as a result of or in any way related to Attendee’s attendance at the Trailer Expo (“Claims”).

Attendee understands and agrees that the foregoing assumption of risk, waiver, release, and indemnification includes any Claims based on the acts, omissions, or negligence of NATM and its employees, agents, and representatives; however, such assumption of risk, release, waiver, and indemnification obligations shall not apply to the extent such Claims are caused by the gross negligence or willful misconduct of NATM, its employees, agents, or representatives.

Attendee agrees to comply with all applicable requirements, advisories, policies, procedures, and protocols of NATM, the Trailer Expo venue, the CDC, and any other governmental authority while attending the Trailer Expo. 

BY REGISTERING YOU WILL WAIVE LEGAL

RIGHTS INCLUDING THE RIGHT TO SUE THE NATIONAL ASSOCIATION OF TRAILER MANUFACTURERS

1. Participation. I, the registered, wish to participate in the National Association of Trailer Manufacturers Trailer Expo at the Oklahoma City Convention Center situated at 100 Mick Cornett Drive, Oklahoma City, OK 73109 (“Location”) hosted by the National Association of Trailer Manufacturers (“Hosting Company”).

2. Assumption of Risks. I hereby assume all risks of attending the Expo and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with attending the Expo. I also hereby hold harmless and release Hosting Company, its members, managers, employees, representatives, and agents, and indemnify each of them from and against any and all loss, claim, cause of action, lawsuit, damage, liability, cost or expense whatsoever which any of them may incur arising out of or in connection with my attendance of the Expo at the Location as an exhibitor, presenter, attendee, or in any other capacity ,including but not limited to the operating, staging, and interacting with exhibited trailers and other heavy equipment to be conducted as part of the Expo; meals, food and beverages served at the Location; and the use of the Location.

3. Waiver. I hereby certify that I am at least 18 years of age (or, if less than 18 years of age, have caused this Liability Waiver and Release to be signed by my parent or legal guardian), I agree that neither I nor any member of my family will sue any Indemnitee because of my attendance of the Expo or my presence at the Location at any time, and I understand that this Release shall be binding upon my estate, my heirs, next of kin, executors, administrators, representatives, successors and assigns. I specifically waive any claim or right to assert any cause of action or alleged case of action or claim or demand which has, through oversight or error intentionally or unintentionally or through a mutual mistake, been omitted from this Liability Waiver and Release.

I understand and agree that the foregoing assumption of risk, waiver, release, and indemnification includes any claims based on the acts, omissions, or negligence of the Hosting Company, its employees, agents, and representatives; however, such assumption of risk, release, waiver, and indemnification obligations shall not apply to the extent such claims are caused by the gross negligence or willful misconduct of the Hosting Company, its employees, agents, and representatives.

4. Covenants Regarding attendance of the Expo. I further agree:

• To pay in full at or before the commencement of the Expo all fees, charges and expenses charged by Hosting Company for the Expo;

• To pay in full before the end of the Expo all charges and expenses that I have incurred while a guest at the Location;

• To obey all rules developed by Hosting Company for the Expo as well as the rules, regulations and staff of Hosting Company, and agree that I may be removed from attendance at the Expo and asked to leave the Location at any time for any reason that Hosting Company's staff deems adequate;

• To be financially responsible for any and all damage that I may cause while at the Location, including but not limited to light fixtures, walls, windows, doors, and vehicles, it being understood that my right to use the Location may be terminated permanently at the sole discretion of Hosting Company if I commit any violent acts while on the Location premises whether intentionally or negligently;

• Not to use narcotic substances of any kind or overindulge in alcoholic beverages while at the Location, it being understood that my right to attend the Expo and stay at the Location may be terminated permanently at the sole discretion of Hosting Company if I am found to be under the influence of any alcoholic beverages or narcotic substances while on the Location premises;

• To assign irrevocably to Hosting Company all rights to my likeness and voice in any photo or video of me taken while I am at the Location;

• To allow Hosting Company to use my name, likeness, image, voice, the city and state of my residence, and biographical and other information concerning me in any such photo or video, in any printed, online or other media now known or hereafter discovered, without compensation, obligation or liability to me of any kind whatsoever.

5. Disclosures Regarding Medical Conditions. I have fully disclosed to Hosting Company any and all medical or psychological conditions, food allergies, dietary restrictions, and other circumstances that may prevent me from fully participating in the Expo at the Location.

6. Governing Law; Amendment; Interpretation of Agreement. This Liability Waiver and Release shall be governed by the laws of the State of Oklahoma, and that any action, claim or proceeding under this Liability Waiver and Release shall be commenced exclusively in the state or federal courts of Oklahoma. This Liability Waiver and Release may not be revoked, terminated or amended verbally, but only by a written instrument signed by me and an authorized representative of Hosting Company. All covenants contained herein are severable, and in the event of any being held invalid by any competent court, this Agreement shall remain intact except for the omission of the invalid covenant.

I HAVE READ AND UNDERSTOOD THIS LIABILITY WAIVER AND RELEASE, HAVE HAD THE OPPORTUNITY TO HAVE LEGAL COUNSEL REVIEW THIS LIABILITY WAIVER AND RELEASE, AND I AM AWARE THAT BY REGISTERING I AGREE TO THIS LIABILITY WAIVER AND RELEASE I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MEMBERS OF MY FAMILY, MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS MAY HAVE AGAINST THE NATIONAL ASSOCIATION OF TRAILER MANUFACTURERS, ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS.
